Collier County Commissioner seeks dismissal of public records lawsuit against him
County Commissioner Bill McDaniel Jr., who is being sued over nearly 350,000 county and personal emails discussing county business, will ask a judge next week to dismiss the lawsuit, arguing that Collier should have been added as a defendant. McDaniel’s attorney, Christopher Stearns of Fort Lauderdale, also contends that under the law, the commissioner is not an “agency” that can be sued. The motion will be heard by Collier Circuit Court Judge Lauren Brody on Monday.
